He reminded everyone that for thousands of years, across cultures and continents, marriage — one of the oldest social institutions — has too often been used to control and silence women. What was meant to be a sacred bond of trust and companionship slowly became a tool for subjugation. But today, that story must change — and the law must lead the change.
Justice Kant made these powerful remarks at a seminar in New Delhi, organized by the Delhi Family Lawyers Association in collaboration with the Delhi High Court Women Lawyers Forum. The event’s theme — “Cross-Cultural Perspectives: Emerging Trends and Challenges in Family Law in England and India” — set the stage for a deep comparative reflection on how both nations are redefining marriage, equality, and rights in the modern age.
Justice Kant said that in both India and England, family law is being rewritten around a single guiding idea — equality between partners. He called marriage not a battlefield of power, but a pious partnership based on mutual respect, shared responsibility, and constitutional values. Marriage, he said, should elevate human dignity — not diminish it.
Tracing India’s journey, Justice Kant explained how ancient customs and religious laws once dictated rules of marriage, legitimacy, and inheritance. Later, the British tried to codify these traditions — but their approach ignored India’s incredible diversity of languages, faiths, and regional practices. The result was confusion and inequality.
Only after independence, he said, did India truly begin to rebuild its family law system from the ground up. The legislature and the judiciary took bold steps — making marriage registration mandatory, creating checks against child marriage, restricting polygamy, and ensuring women’s right to maintenance, inheritance, and residence.
He also addressed a major modern challenge — the recognition of foreign divorce decrees. Justice Kant urged courts to act with mutual respect between nations — the legal principle known as comity of courts — but also reminded them that the welfare of the child must always come first. “No judgment,” he said, “is just if it forgets the child.”
Justice Surya Kant’s message goes far beyond the courtroom — it’s about reshaping the way we understand relationships, respect, and equality. The next revolution in Indian law, he says, will not just happen in the Parliament or the Supreme Court… it will happen inside every home, every family, and every heart.
